A 42-year-old has been sentenced to 15 years in prison after being found guilty of defiling his 8-year-old daughter.
The judgment was delivered at the Kabarnet Law Courts by Senior Principal Magistrate Hon. P. Koskey, following a successful prosecution led by Counsel Collins Ogutu, who proved the case beyond reasonable doubt.
The offence occurred on multiple occasions in December 2024. The accused, man from Bepyemit Village in Kabartonjo, Baringo County, who is the child’s biological father, visited the victim’s mother under the pretext of taking the child out to buy slippers.
He then spent the night with the minor at his rented residence in Kabartonjo, where the crime was committed. Prosecution presented six witnesses, including the minor, and relied on critical medical and forensic evidence that corroborated the allegations and clearly established the offence of incest. In delivering the sentence, Hon.
Koskey emphasized the gravity of the crime, referencing both the pre-sentence report and the victim impact statement. He highlighted the severe psychological harm inflicted on the child and stressed the importance of imposing a strong deterrent to prevent similar offences.
This conviction reinforces the ODPP’s unwavering commitment to protecting vulnerable members of society and securing justice for survivors of sexual and gender-based violence.
