A key suspect in the ongoing case of the murder of Kasipul Member of Parliament Charles Ong’ondo Were reportedly threatened to kill a prosecutor.
The Office of the Director of Public Prosecutions (ODPP), told the court during the cse’s hearing on Wednesday 4, 2025, that Lake Basin Development Authority (LBDA) board member Ebel Ochieng had made the threats after the prosecutor handling the case opposed them being granted bail.
The ODPP said, the threat occurred during a court recess as the judge was preparing to issue the way forward. ”The Court heard from a court orderly that when the court had taken a break for the judge to give directions, one of the suspects, Ebel Ochieng Alias Dave Calo, reached out to the court orderly officer and inquired who the prosecutor was and threatened to kill him for opposing them being granted bail,” stated the ODPP.
Following the revelation, Justice Diana Kavedza Mochache, who was presiding over the case, ruled that all three suspects be remanded at Nairobi Industrial Remand Prison.
The court further ordered one of the suspects to undergo a mental assessment. The suspect will remain in isolation pending the outcome.
In her ruling the judge said “I take note that the accused person has threatened to kill the prosecutor. The mere utterance of the words ‘huyu tutamuua’—the question is, what about the witnesses? On these grounds, the three are denied bond/bail. The first accused is to be escorted to Mathari Hospital for assessment.”
The judge also ordered heightened security in the courtroom going forward following the incident.
The case is set to be mentioned again on June 17.
Separately, two more suspects appeared before Milimani High Court to answer to charges of the murder. During the hearing, the court also directed that all the suspects be taken to Mathari Hospital for mental assessment.
The two suspects, Isaac Kuria, alias Kush, and Allan Omondi Ogola, will be held at the Kamiti Prison pending mental assessment.
The case is scheduled for further mention for direction on June 18.
