Judge Lawrence Mugambi has ordered the transfer of a petition filed by officers Samson Taalam and James Mukhwana to the Kibera Law Courts after it was indicated in the submissions that the matter was already before Kibera Court where they also had taken plea in connection with the murder of blogger Albert Ojwang.
Through his lawyer Danstan Omari, Nairobi Central Police Station Samson Taalam had sought High Court halting the murder trial and instead order an inquest into the blogger’s death arguing that the High Court had jurisdiction and should hear the matter.
However, the judge Mugambi noted that the issues raised could be adequetely addressed at the lower court
“The orders in the miscellaneous file are spent, and the court has assumed jurisdiction. The argument is sound. Any objections to continued detention can be made before the Kibera court.” noted Judge Mugambi.
Justice Mugambi directed that the file be transferred to the Kibera Law Courts for further directions.
